Optive, Inc. ("Optive," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, and disclose information when you visit optive.net or use other Optive websites, landing pages, forms, assessments, surveys, events, or online features that link to this policy (collectively, the "Site").

Optive, Inc. is a Delaware corporation based in the United States.

This policy covers our public websites and related marketing and research activities. It does not govern the Optive software platform or information processed through practitioner or patient accounts. Those services may be covered by separate privacy terms.

Information we collect

Information you provide

We collect information you choose to give us, such as your name, email address, practice or company, professional role, interests, and other information you provide when you sign up for updates, request early access, complete a form or assessment, participate in research, register for an event, contact us, or otherwise interact with Optive.

If you provide feedback, survey responses, assessment answers, or other research information, we may use that information to understand practitioner needs, develop Optive, and produce aggregated or de-identified research, insights, or benchmarks.

Please do not submit patient records, protected health information, or other sensitive clinical information through general Site forms unless we specifically provide a feature intended for that purpose. Where a feature collects health information about an individual, the Consumer health data section below also applies.

Information collected automatically

When you use the Site, we may automatically collect information such as your IP address, approximate location, browser and device information, operating system, referring page, pages viewed, links clicked, dates and times of visits, interactions with the Site, campaign or referral information, and similar technical or usage information.

We may collect this information using cookies, pixels, local storage, server logs, analytics tools, unique identifiers, and similar technologies.

We may use these technologies across Optive websites, landing pages, assessments, forms, and related online experiences to understand how people interact with Optive over time.

We may also associate information collected through cookies and similar technologies with information you provide to us, including when you complete a form, assessment, registration, or other interaction that identifies you.

How we use information

We use information to:

• operate, secure, maintain, and improve the Site;
• respond to questions and requests;
• manage early-access programs, assessments, registrations, and other programs;
• send Optive news, updates, invitations, research, and educational content;
• understand how people find and use Optive;
• measure campaign and referral performance;
• understand interests, engagement, and interactions across Optive properties;
• personalize communications and experiences;
• conduct research and develop our products and services;
• detect fraud, abuse, or security issues; and
• comply with legal obligations and protect our rights.

We may combine information collected from different parts of the Site with information we receive from partners, event organizers, or services that help us operate, analyze, and market Optive.

We may also use information that has been aggregated or de-identified so that it no longer reasonably identifies you.

Cookies and tracking technologies

We use cookies and similar technologies as part of operating, measuring, improving, and marketing Optive.

These technologies may help us:

• recognize returning visitors;
• understand how people move through Optive websites and related experiences;
• maintain session information;
• remember preferences;
• measure engagement;
• understand which campaigns or referrals brought someone to Optive;
• connect earlier Site activity with later form submissions, assessments, or registrations; and
• improve our communications, products, and marketing.

Some technologies may be provided by companies that help us with hosting, infrastructure, analytics, advertising, communications, security, measurement, or other services. If we work with advertising partners, they may use these technologies to measure or show Optive ads on other sites.

You may be able to block or delete cookies through your browser settings, but doing so may affect how the Site or related features work.

The Site does not respond to browser Do Not Track signals.

How we disclose information

We may disclose personal information to companies that help us operate Optive, including providers of hosting, infrastructure, analytics, advertising, AI and automation tools, communications, email delivery, customer relationship management, forms and surveys, measurement, security, customer support, and professional services.

We may also disclose information to partners we work with on joint programs, such as co-branded assessments, events, or research. When a program is offered with a partner, we tell you who they are.

We may also disclose information when reasonably necessary to comply with law or legal process; protect the rights, security, or property of Optive, our users, or others; investigate fraud or abuse; or enforce agreements.

If Optive is involved in a merger, financing, acquisition, reorganization, sale of assets, or similar transaction, information may be disclosed or transferred as part of that transaction.

We may also disclose information at your direction or with your consent.

Sale and targeted advertising

We do not sell personal information.

Some U.S. privacy laws separately regulate certain forms of targeted advertising or data sharing, even where information is not sold.

If we engage in activities that create an applicable legal right to opt out, we will provide a way to exercise that right.

Email and communications

If you ask to hear from Optive, we may send you product updates, invitations, research, educational content, early-access information, and other communications relating to Optive.

You can unsubscribe from marketing emails at any time using the unsubscribe link in the message. We may still send communications you specifically request or messages necessary to administer an existing relationship with you.

Data retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including operating the Site, communicating with you, maintaining business records, conducting research, protecting Optive, resolving disputes, and meeting legal obligations.

How long we retain particular information depends on what it is, why we collected it, and whether we have an ongoing business or legal reason to keep it.

When information is no longer needed, we may delete or de-identify it.

We may retain limited information necessary to honor an unsubscribe, deletion, or other privacy request.

Your privacy rights

Depending on where you live and subject to applicable law, you may have rights relating to your personal information. These may include the ability to request access to, correction of, deletion of, or a copy of certain information, as well as the ability to opt out of certain uses of information for targeted advertising, profiling, or disclosures treated as a sale under applicable law.

You may submit a privacy request through optive.net/contact. Where the law allows, an authorized agent may submit a request for you.

We may need to verify your identity before completing a request. We will process applicable requests in accordance with the law and will not discriminate against you for exercising a privacy right. If we decline a request, you may appeal through the same page, and we will explain our decision.

Consumer health data

Most of the Site is built for healthcare and wellness professionals and does not collect consumer health data. This section applies only where a feature collects information linked to a person that reveals or is used to infer something about their physical or mental health, such as a tool that helps someone find a practitioner or a tool a practitioner uses with their patients.

Where a feature asks for it, we collect health information provided to us, such as health goals, concerns, conditions, or the type of care someone is looking for. We collect it directly from you, or from a practitioner you are working with. We use it only to provide the feature it was submitted for, and for any other purpose you consent to.

With your consent, we share consumer health data with the practitioners or practices involved in the feature you use. Service providers that process this data for us do so only under our instructions. We do not sell consumer health data.

You can ask us to confirm whether we collect, share, or sell your consumer health data; to access it, including a list of the third parties we have shared it with; to withdraw your consent; and to delete it. Requests and appeals are handled as described in "Your privacy rights" above.

Security

We use administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, or alteration.

No Internet service or method of electronic storage is completely secure, and we cannot guarantee absolute security.

Children

The Site is intended primarily for healthcare and wellness professionals and other adults interested in Optive. It is not directed to anyone under 18, and we do not knowingly collect personal information from anyone under 18 through the Site.

If you believe a minor has provided personal information to us through the Site, please contact us.

Changes to this policy

We may update this Privacy Policy as Optive, the Site, and our privacy practices evolve.

When we make changes, we will post the updated policy and revise the effective date above. If a change materially affects how we handle personal information, we may provide additional notice where appropriate or required by law.
